This policy applies to all SMS communications sent by or on behalf of CXT Software, including service notifications, operational alerts, delivery confirmations, account updates, and any other text-based communications to customers, drivers, dispatchers, and other platform users. It supplements our main Privacy Policy and should be read together with it.

Information We Collect

When you opt in to our SMS program, we may collect the following information:

  • Mobile phone number provided at opt-in
  • Date, time, and method of consent
  • Inbound message content (e.g., STOP, HELP, or other keyword replies)
  • Message delivery status and carrier information

We do not collect financial information, government-issued identifiers, or other sensitive personal data through our SMS channels. For a full description of personal data we collect across all Services, please refer to our main Privacy Policy.

How We Use Your Information

We use the information collected through our SMS program to:

  • Deliver the SMS messages you have consented to receive
  • Send transactional and operational notifications related to your use of CXT Software products (e.g., dispatch alerts, delivery confirmations, account status updates)
  • Process opt-out requests and honor STOP commands promptly
  • Respond to HELP requests and provide customer support
  • Maintain records of consent and message activity for compliance purposes
  • Improve the reliability and quality of our messaging services

We will not use your mobile number for marketing or promotional campaigns without obtaining separate, explicit consent.

Sharing of Information

We do not sell, rent, or lease your mobile phone number or SMS-related information to third parties. We may share your information only in the following limited circumstances:

  • Service Providers: We engage SMS gateway providers and telecommunications carriers to facilitate message delivery. These providers are contractually restricted from using your data for any purpose other than delivering our messages.
  • Legal Compliance: We may disclose information as required by applicable law, regulation, legal process, or governmental request, consistent with our main Privacy Policy.
  • Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our business or assets, your information may be transferred as part of the transaction. Where required by applicable law, we will make reasonable efforts to direct the recipient to use your data in a manner consistent with this policy.
  • Protection of Rights: We may disclose information when necessary to protect against and prevent fraud, illegal activity, or to protect the rights, property, or safety of CXT Software, our users, or the public.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Opt-In and Consent

By providing your mobile phone number and affirmatively consenting to receive SMS messages from CXT Software, you agree to receive text messages at the number provided. Consent may be obtained through:

  • Online account registration or profile settings within the CXT Software platform
  • A signed agreement or service contract that includes SMS notification consent
  • A double opt-in process via SMS keyword confirmation

Consent to receive SMS messages is not a condition of purchasing or using our Services. Message and data rates may apply. Message frequency varies based on account activity and service tier.

Opt-Out Instructions

You may opt out of receiving SMS messages from CXT Software at any time using any of the following methods:

  • Reply **STOP** to any SMS message you receive from us. You will receive a one-time confirmation that your opt-out has been processed.
  • Update your notification preferences within your CXT Software account settings.
  • Contact us directly to request removal.

After opting out, you will no longer receive SMS messages except where required by law or where messages are inherently transactional and cannot be suppressed (e.g., security alerts initiated by your account activity). To re-enroll, you may opt back in at any time through the methods above.

HELP Command

At any time, you may reply **HELP** to any SMS message from CXT Software to receive information about the program and available support options. You may also contact us directly using the information below.

Data Retention

We retain SMS-related data consistent with our general data retention practices described in the main Privacy Policy, and in accordance with applicable legal requirements. Specifically:

  • Consent records are retained for a minimum of four (4) years from the date of consent or last message interaction, whichever is later.
  • Opt-out records are retained indefinitely to prevent inadvertent re-enrollment.
  • Message content logs are retained for up to ninety (90) days for operational and troubleshooting purposes, unless a longer retention period is required by law.

Upon expiration of the applicable retention period, data is securely deleted or anonymized in accordance with our standard practices.

Security

We have put in place reasonable administrative, technical, and physical safeguards designed to protect your information against unauthorized access, disclosure, alteration, and destruction. Our SMS infrastructure leverages industry-standard encryption for data in transit and access controls to limit exposure of message logs and consent records. However, there is no guarantee that information in any system is completely secure, and we cannot guarantee absolute security of transmissions over mobile networks.

Children's Privacy

Our SMS services are not directed to individuals under the age of 13, and children under 13 are prohibited from using the Services. We do not knowingly collect personal information from children under 13. If we learn that we have received information from a child under 13 without parental written consent, we will take steps to delete that information promptly. If you believe a child under 13 may have provided us with personal information, please contact us at [email protected].

If you have questions, concerns, or requests regarding this SMS Privacy Policy or our text messaging practices — including any requests to exercise your legal rights under applicable privacy law — please contact us:
